§ 34-41. Provision of water service to residential properties immediately adjacent to city limits.

  • The city may provide municipal water service to residential properties abutting the city's corporate boundaries, provided the following criteria are met:

    (1)

    The residential property must meet the following classifications:

    a.

    The residence to be served must be located within 200 feet of the city's corporate boundaries; and

    b.

    The residence to be served must be located within 200 feet immediately accessible city water main of adequate capacity. The city, in its sole discretion, shall determine all issues relating to access and adequacy of supply.

    (2)

    The property at issue must be zoned for residential uses only.

    (3)

    The hookup and meter fees are paid. Additionally, the person(s) requesting city water service are responsible for costs for material and labor for installation of the water service pipe from the city water main to the residence. All such plumbing and installation shall meet or exceed those standards and specifications required by the city.

    (4)

    In the event such residential water service is approved by the city council, it may be continued beyond 60 days only upon adequate written proof of residential well closure, in compliance with applicable legal and administrative regulations.
